  • Referrers, including architects, engineers, and other professionals who introduce you to us

Why we use your personal data and our legal basis

We process personal data only where we have a lawful basis to do so under Article 6 GDPR. The table below summarises the main purposes and the legal basis we rely on.

To respond to enquiries and provide consultations

Legal basis: taking steps at your request prior to entering into a contract (Article 6(1)(b)).

When you submit the enquiry form or contact us, we use your details to review your enquiry, confirm a consultation, send any pre-consultation information, and follow up.

To provide our design and build services

Legal basis: performance of a contract with you (Article 6(1)(b)).

If you engage BuildTech, we process your personal data to deliver feasibility, design, planning, cost planning, construction, certification, and aftercare services, and to administer the client portal.

To comply with our legal and regulatory obligations

Legal basis: compliance with a legal obligation (Article 6(1)(c)).

This includes record-keeping under tax law, building control and certification requirements, health and safety obligations, planning regulations, and accounting standards.

To operate, secure, and improve our website

Legal basis: our legitimate interests in running a secure, functional website and understanding how it is used (Article 6(1)(f)).

We will not publish your name, identifiable address, or interior photography in a case study, social media post, or marketing material without your prior consent. Generic exterior photographs taken from the public road may be used as non-identifiable project examples unless you object.

Who we share your personal data with

We share personal data only where necessary and only with parties who are bound by appropriate confidentiality and data protection obligations. Categories include:

  • Design and construction professionals: architects, structural engineers, chartered engineers (for certification), planning consultants, quantity surveyors, energy assessors, and subcontracted trades engaged for your project.
  • Local authorities and statutory bodies: where required for planning applications, building control submissions, BER certification, or grant applications (e.g. SEAI).
  • Technology providers: website hosting, CRM and email automation, client portal, analytics, advertising platforms, cloud storage, document signing, and accounting software.
  • Professional advisors: accountants, auditors, insurers, and solicitors where relevant.
  • Regulators and law enforcement: where we are required by law to disclose information.

We do not sell personal data to third parties.

International data transfers

Some of our service providers may process personal data outside the European Economic Area (EEA), for example providers based in the United States. Where this happens we rely on appropriate safeguards under Articles 45 to 49 GDPR, including:

  • European Commission adequacy decisions (including the EU-US Data Privacy Framework where applicable)
  • Standard Contractual Clauses approved by the European Commission
  • Additional technical and organisational measures where required

How long we keep your personal data

We keep personal data only for as long as necessary for the purposes set out in this Policy. Indicative retention periods:

  • Website enquiries that do not progress: up to 24 months from last contact, then deleted or anonymised.
  • Consultation records (where no project follows): up to 3 years.
  • Client project records, drawings, certificates, and correspondence: minimum of 12 years from practical completion, to align with the statute of limitations for construction works under the Statute of Limitations Act 1957 (as amended) and Building Control requirements.
  • Accounting and tax records: 6 years from the end of the relevant tax period, as required by Revenue.
  • Marketing consents and unsubscribe records: retained for as long as needed to honour your preferences.
  • Server and security logs: typically 12 months.

Your rights under GDPR

Subject to the conditions set out in GDPR, you have the right to:

  • Access your personal data and receive a copy.
  • Rectification of inaccurate or incomplete data.
  • Erasure (the “right to be forgotten”) where applicable.
  • Restriction of processing in certain circumstances.
  • Data portability for data you provided to us and which we process by automated means on the basis of consent or contract.
  • Object to processing based on legitimate interests or for direct marketing.
  • Withdraw consent at any time where we rely on consent (withdrawal does not affect prior processing).
  • Not be subject to automated decision-making that produces legal or similarly significant effects. BuildTech does not carry out such automated decision-making.

If a personal data breach occurs that is likely to result in a risk to your rights and freedoms, we will notify you and the Data Protection Commission as required by GDPR.

Children

Our website and services are intended for adults. We do not knowingly collect personal data from children under 16. If you believe we hold data about a child, contact us and we will delete it.

Third-party links and embedded content

Our website may contain links to third-party websites (e.g. Google, YouTube videos embedded on project pages, social media links, OnlineTradesmen and Houzz review listings).
